By agreeing to the terms and conditions herein you have agreed
to allow Leo Al Tech to access your computer for purposes of remote
desktop support. BY USING THIS SERVICE, YOU ARE AGREEING TO BE
BOUND BY THE FOLLOWING TERMS AND CONDITIONS, HEREAFTER THE "AGREEMENT."
1. Limited Warranty. The software and services of Leo Al Tech
are provided on an as-is basis and without warranty of any kind
and Leo Al Tech expressly disclaims all warranties, express or
implied, including, but not limited to, implied warranties of
merchantability and fitness for a particular purpose with regard
to both software and/or services rendered by Leo Al Tech.
2. Limitation of Liability. Under no circumstances shall Leo
Al Tech be liable for any incidental, special or consequential
damages that result from the use of, or the inability to use,
your computer networks, individual computers, or their peripheral
attachments as a result of services provided by Leo Al Tech, whether
based on breach of contract, tort (including negligence), product
liability or otherwise, or for any defects, including viruses
on your computer hardware or in software programs. In no event
shall Leo Al Tech's total liability to you for all damages, losses,
and causes of action (whether in contract, tort, including negligence),
or otherwise, exceed the amount paid by you for services rendered
by Leo Al Tech.
3. Controlling Law and Severability. This Agreement shall be
governed by and construed in accordance with the laws of the United
States and the State of California, and shall be subject to binding
arbitration pursuant to the guidelines of the American Arbitration
Association. If for any reason a court of competent jurisdiction
finds any provision of this Agreement or portion thereof, to be
unenforceable, that provision of the Agreement shall be enforced
to the maximum extent permissible so as to effectuate the intent
of the parties and the remainder of this Agreement shall continue
in full force and effect.
4. Complete Agreement. The terms and conditions contained in
this Agreement contain the entire agreement between the parties
with respect to Leo Al Tech's remote assistance service and this
Agreement supersedes all prior or contemporaneous understandings
or agreements, written or oral, regarding such matter. No amendment
of this Agreement may be made unless in writing and signed by
a duly authorized representative of Leo Al Tech.
